This just in: Timothy E. Flanigan has just withdrawn his nomination to serve as Deputy Attorney General, the #2 position at the Department of Justice. (Article Three Groupie got all excited when she saw the words "Nominee" and "Withdraws" in the headline, but as it turned out, the news did not relate to Harriet Miers.)
As noted in this Legal Times profile by Vanessa Blum (gavel bang: Orin Kerr), Tim Flanigan -- currently a senior vice president and general counsel for corporate and international law at Tyco International* -- previously served as a Deputy White House Counsel, under Alberto Gonzales. Flanigan was also a partner in the Washington office of White & Case, and he belonged to the litigation team representing the Bush-Cheney campaign in the disputed 2000 election.
Back in the administration of President George H.W. Bush, Timothy Flanigan was headmaster of the Finishing School for the Elect. As one would expect from someone with such a glittering resume, Flanigan is one of the Elect himself. He clerked for the favorite justice of Harriet Miers, Chief Justice Warren E. Burger, in October Term 1985.
Now the question becomes: Who will be the next DAG nominee? If you have any gossip on this topic, please email A3G. Thanks!
* As noted here, Flanigan is not the general counsel of Tyco.
We're all hoping for that withdeaw.
