With his former boss, Judge J. Michael Luttig, hoping and praying for Harriet Miers to crash and burn, Professor Stras's criticism of the nomination is not surprising. In fact, it is fully consistent with the bile that the bitter, passed-over Judge Luttig has been spewing over at his blog.*
(In case you're wondering, yes, A3G has made deliberate decisions (1) to always refer to Harriet Miers using her first and last names, and (2) to use this post as the link for every mention of "Harriet Miers." These stylistic choices serve to underscore that vaguely ridiculous, almost laughable quality to Harriet Miers -- and the fact that Harriet Miers has been nominated to the Supreme Court.)
* Luttig's Lair is, quite obviously, a parody. Although several judges have blogs, Judge Luttig is not among them. Given Judge Luttig's burning desire to sit on the Supreme Court, combined with the fact that one his biggest liabilities is his reputation as an outspoken conservative, don't hold your breath waiting for him to join the blogosphere.
If Luttig seriously wants to serve on SCOTUS, he should consider getting his supporters to tone down the anti-Miers stuff. I expect there will be another opening and Luttig's best bet would be to tell his friends to support Miers. Bush is a big fan of loyalty and conversely has a good memory about those who he thinks have undermined him.
